Terms of Service

1. Scope

These Terms govern the conditions under which the Service is provided and the rights and obligations between the operator and users, and apply to all use of the Service.

Any separate notices or guidance published by the operator within the Service form part of these Terms.

2. Accounts

Please register with a valid email address. You cannot sign in until your email has been verified.

You are responsible for managing your password and your account. Accounts may not be lent, transferred or shared.

Any action taken through an account is deemed to have been taken by the user of that account.

You may delete your account from within the app at any time. Deleting your account also deletes your stored settings, fingerings and scores, as well as any posts you had published.

3. Prohibited conduct

Acts that violate laws or public order, or that lead to criminal activity.

Acts that infringe the copyright, trademark, portrait, privacy or other rights of the operator, other users or third parties.

Acts that interfere with the operation of the Service, such as placing excessive load on it, unauthorised access, or circumventing authentication.

Impersonating another person or registering false information.

Reusing or redistributing the Service for commercial purposes without permission.

Repeatedly using the removal request feature without proper grounds.

4. Posting and sharing scores

Users may publish scores they have loaded into the Service by sharing them.

The poster warrants that they hold all rights necessary to post, publish and distribute the content they submit.

Posting content that infringes the copyright or other rights of a third party is prohibited. You may not post or share MusicXML or MIDI based on commercial sheet music, or on works for which you do not have the rights holder's permission.

If the operator receives a report of infringement or a similar complaint, the operator may make the post private or delete it without prior notice to the poster. A post that receives a removal request is automatically hidden until the operator has reviewed it.

The poster bears responsibility for any infringement of rights arising from their post, except for liability that the operator bears under applicable law. If a dispute arises with a third party, the poster shall resolve it at their own cost and responsibility.

The operator may make private or delete, at any time, any content it judges may violate these Terms or the law.

5. Handling of posted content

Copyright in posted content remains with the poster or the rightful owner. The operator does not acquire those rights.

The poster grants the operator a royalty-free licence to reproduce, transmit and display the posted content to the extent necessary to provide, operate and publicise the Service.

Only the sequence of notes is published. Fingering records and the original file used for loading are not published.

The operator does not guarantee that posted content will be retained. Please keep your own copies of anything important.

6. Changes, suspension and termination

The operator may change the contents of the Service, or suspend or end its provision, without prior notice to users.

The Service may be temporarily unavailable due to maintenance, faults, natural disasters or other unavoidable circumstances.

7. Disclaimer

The Service is provided as is. The operator does not warrant that the Service is free from defects in fact or in law.

Fingering, position and pitch judgements are guidance only and their accuracy is not guaranteed.

Except in cases of wilful misconduct or gross negligence by the operator, the operator is not liable for damage arising from use of the Service.

Disputes between users, or between a user and a third party, shall be resolved between the parties concerned.

8. Suspension of use

If the operator judges that a user has breached these Terms, it may hide or delete posts, suspend use of the Service, or delete the account, without prior notice.

9. Use by minors

Minors should use the Service with the consent of a parent or guardian. The same applies to registering an account and to posting scores.

10. Personal information

The handling of information we receive is governed by our separate Privacy Policy.

11. Changes to these Terms

The operator may amend these Terms when it judges it necessary. When we do, we will update the date at the bottom of this page.

By continuing to use the Service after a change, you are deemed to have agreed to the amended Terms.

12. Governing law and jurisdiction

These Terms shall be interpreted in accordance with the laws of Japan.

Any dispute concerning the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the operator.
